Terms and Conditions

These terms and conditions along with the information contained on our Website form the contract between Nomadic Ski and the Customer.

1. Definitions

In these terms and conditions the following expressions shall have the following meanings:

‘Accommodation’ means any one of the Chalets owned or operated by Nomadic Ski.
‘Arrival’ means the date on which You arrive at the Accommodation.
‘Customer/Customers’ means all those individuals that are party to the Reservation, including the Lead Customer.
‘Lead Customer’ means the person making the Reservation.
‘Nomadic Ski’ means Nomadic Ski Holidays Ltd a company incorporated in England and Wales (registered number 04982784) whose registered address is Rossfield, Howick, Chepstow, Monmouthshire NP16 6BQ.                     
‘Purchase Price’ means the total price of Accommodation and any other services that are confirmed in the Reservation.
‘Reservation’ means a contract between the Customer and Nomadic Ski to purchase Accommodation, Services and/or Third Party Services.
‘Services’ means any service provided directly by Nomadic Ski.
‘Third Party Services’ means any service not directly provided by Nomadic Ski.
‘Us/We/Our’ means Nomadic Ski Holidays Ltd its employees associates or agents.
‘You/Your’ means the Customer

2.  Reservations

Reservations will only be accepted from adults over the age of 18 years.  Nomadic Ski reserves the right to refuse a Reservation where Customers will be under the age of 18 at the time of travel. The Lead Customer is responsible for providing correct information for all Customers.
For a Reservation to become effective, the following steps must be applied:

The Lead Customer will contact Nomadic Ski by telephone, in writing or by email setting out their request.
Nomadic Ski will confirm availability at the time of request
The Lead Customer confirms verbally or via email that they wish to proceed on the basis discussed.
Nomadic Ski shall hold the request for 5 working days. During this time a deposit equal to 30% of the Purchase Price per person must be received by Nomadic Ski.
An email confirming receipt of the deposit will be sent by Nomadic Ski to the Lead Customer.
On completion of steps 2.2.1 – 2.2.5, the Reservation becomes effective and legally binding.

Deposits are only refundable if We are unable to accept Your Reservation.
The Lead Customer is responsible for providing correct information for all Customers.
The remaining balance of the Purchase Price is payable in full no later than 8 Weeks prior to Arrival.
Reservations made within 8 Weeks of Arrival must be paid in full at the time of making.  If the Purchase Price is not received on time We reserve the right to cancel Your Reservation, without any obligation to refund or make alternative arrangements as per clause 3.
Payment of the Deposit and remaining balance are to be made by UK bank transfer, debit card, credit card or UK cheque only (see below for in-resort payments).  Please note that payments made by credit card may attract a charge equal to 2% of the payment amount. Such a charge is at the discretion of Nomadic Ski.

3.  Cancellation by You

Cancellation may only take effect upon receipt of written notification received by Nomadic Ski from the Lead Customer, by email or letter in accordance with clause 23.
We reserve the right to charge cancellation fees to compensate against losses incurred by Us.
Cancellation fees are set out below and are applicable from the day Nomadic Ski receives valid notification:

Up to 8 Weeks prior to arrival - Deposit (30%)

Up to 6 Weeks prior to arrival - 45% of total price

Up to 4 Weeks prior to arrival - 60% of total price

Up to 2 Weeks prior to arrival - 75% of total price

Less than 14 days prior to arrival - 100% of total price

4.  Cancellation or alteration by Nomadic Ski

Nomadic Ski reserves the right to cancel or alter the Reservation. 
In the unlikely event that Nomadic Ski has to alter or cancel the booking, the Customer shall be offered the choice of suitable alternative arrangements or a full refund, unless the cancellation or alteration is due to circumstances beyond our control. Such circumstances are those that Nomadic Ski could not have foreseen and include, but are not limited to war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, technical problems with transport, closure or congestion of airports or ports, adverse weather conditions, avalanches and similar events beyond Nomadic Ski’s control such as acts of God.  Nomadic Ski accept no responsibility or liability for such events. 
In such circumstances beyond Our control Nomadic Ski will not be liable to pay any compensation to, offer any refund or offer alternative arrangements to the Customer. Any offer to pay the Customer a refund is completely at the discretion of Nomadic Ski.
 The Customer shall be notified of any alterations or cancellations as soon as is reasonably practicable.

5.  Changes by You

Should You wish to make any alterations to Your Reservation, You will need to inform Us in writing (via email or post) immediately to the address specified in Clause 23. Whilst We will endeavour to meet Your requests We cannot guarantee it.
Nomadic Ski reserves the right to charge an administration fee to make any alterations to Your Reservation to enable Your requests to be met and will inform the Customer of any such costs as soon as possible.  Where the alteration is to Third Party Services, Nomadic Ski is not responsible for any costs incurred by that third party and You will remain liable to them for such costs and any outstanding balance in payment for the service to be provided.
For the avoidance of doubt, if the Customer alters the Reservation, each and every alteration will be treated as a variation to the contract between Us and the Customer.

6.  Check-in

Customers may collect their keys for the Accommodation between 1500 and 1900 hours on the day of Arrival unless otherwise agreed by Us in writing.

7.  Deposit

Where the Reservation does not include a catered service, a deposit of €400 is payable by credit card upon arrival.  This deposit will be returned within 10 days of departure, less any deductions incurred for cleaning and damages that You have not made Us aware of and paid for.  Nomadic Ski shall be entitled to recover from the Lead Customer costs for damages or losses caused by the Customer or a third party.

8.  Inventory

Nomadic Ski will provide an inventory for Accommodation and it is the Lead Customer’s responsibility to check that all the information is correct on receipt and, where the Reservation does not include a catered service, the Lead Customer shall sign the Inventory which shall constitute agreement with it. In the event that there are any discrepancies, the Lead Customer should contact Nomadic Ski immediately.

9.  Check-out

Customers must return their keys by 1100 hours on the day of departure.  It is the Customer’s responsibility to ensure that the Accommodation is left in a clean and tidy condition.  Any breakage of any items must be reported to Nomadic Ski immediately. The Lead Customer will be responsible for the costs of all breakages. 
The Customer shall be responsible for all direct expenses reasonably incurred by Us in the collection of any sums outstanding to Us.
The Customer must indemnify Nomadic Ski against any claims (including legal costs) subsequently made against Nomadic Ski as a result of his/her actions.

10.  Insurance

It is the Lead Customer’s responsibility to ensure that each Customer carries adequate insurance for travel, health, accommodation and all the activities in which they are to participate.  Nomadic Ski will not accept any liability for personal injury, loss whether economic or other and/or damage. 

11.  Exclusions

All Reservations exclude flights.
Accommodation does not include transfers between Geneva airport and the resort of Chamonix unless otherwise stated.
It is the Customer’s responsibility to ensure that all the relevant travel documentation is in place such as Visas, valid passports and any other such documentation that is required. Nomadic Ski accept no responsibility in the event that the immigration officer refuses entry.

12.  Transfers

Where a Reservation includes transfers between Geneva airport and the resort of Chamonix, all Customers are required to arrive and depart at the same time. In the event that some Customers have different flight times We reserve the right to make an additional charge for arranging separate transfers at the market rate

13.  Special Requirements

Please let Us know of any special requirements (for example: food, disability access) at the time of making Your Reservation.  Although We cannot guarantee it, We will do our best to meet Your request but failing to do so will not constitute a breach of contract on our part.
